Terms of Service

By creating an account, accessing, or using the Interview Express platform and services (the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old.

Interview Express is an AI-powered interview screening platform designed for employers. The Service includes:

• Voice-based AI interviews conducted by an AI agent
• Automated transcript capture and processing
• AI-driven candidate evaluation and scoring
• Candidate management and analytics dashboards
• Multi-organization and team collaboration features

To use the Service, you must register for an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• You must provide accurate and truthful information during registration and keep it up to date
• You are solely responsible for safeguarding your password and account credentials
• Users may belong to multiple organizations and switch between them
• Organization administrators may invite users to join their organization
• A single user account may be associated with multiple organizations
• Each organization maintains its own separate data, credits, and billing
• We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful activity

The Service operates on a credit-based consumption model. Credits are required to conduct AI interviews and access platform features.

• Credits are non-refundable, non-transferable, and non-exchangeable for cash
• Credit consumption varies based on real-world usage — the cost depends on market price variations of underlying AI, speech recognition, speech synthesis, and infrastructure technologies, as well as the duration, depth, complexity, and outcome of each interview session
• Example: A typical 30-minute AI interview may cost approximately 150 credits as a rough estimate, but actual consumption can be higher or lower depending on the nature of the interaction, which cannot be predicted in advance
• We reserve the right to adjust credit pricing and consumption rates as underlying service costs change. Updated pricing will be reflected on our platform
• Auto-recharge: If enabled by the organization administrator, charges occur automatically when balance drops below the configured threshold
• Unused credits do not expire but are forfeited upon account termination for cause by us
• Upon voluntary termination by you, unused credits are forfeited and non-refundable

All credit purchases are final and non-refundable.

• Credits once consumed cannot be reversed or restored
• No refunds will be issued for unused credits, partially completed interviews, or dissatisfaction with AI-generated results
• Disputed charges must be raised within 30 days of the transaction

This no-refund policy exists because credits are consumed by third-party services (AI inference, speech processing, real-time communication infrastructure) whose costs are incurred immediately and irrecoverably upon use.

Nothing in this section limits any rights you may have under the Consumer Protection Act, 2019 or other applicable law.

• AI evaluations are assistive tools only, not definitive hiring decisions
• Scores, personality traits, and risk flags are AI-generated assessments, not professional psychological or clinical evaluations. These outputs have not been validated against established psychometric standards and should not be treated as such.
• The subscribing organization is solely responsible for all hiring decisions made using the platform
• We do not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated output
• AI models are probabilistic in nature and may produce varying results for similar inputs
• AI outputs should not be the sole basis for any employment decision. Organizations must ensure independent human review of all AI-generated assessments before making adverse employment decisions

Employers are responsible for obtaining informed consent from candidates before sending interview invitations. Specifically, employers must inform candidates that:

1. The interview is conducted by an AI agent, not a human
2. The interview will be transcribed and analyzed by AI systems
3. AI-generated evaluations will be produced
4. If recording is enabled, the interview audio will be recorded and stored

Employers must provide candidates with access to our Privacy Policy before or at the time of invitation. We act as a data processor on behalf of the employer (data controller) for candidate data.

Employers are responsible for ensuring that all candidates invited to interviews are at least 18 years of age. If an employer becomes aware that a candidate is under 18, they must immediately notify us and refrain from using the Service for that candidate.

Anti-Spam & Unwanted Invitations: If we receive multiple reports or indications from candidates that they did not expect, request, or consent to receiving interview invitations from an organization, we reserve the right to investigate and, at our sole discretion, suspend or permanently terminate the organization’s access to the Service. Repeated sending of unsolicited interview invitations constitutes a violation of these Terms and applicable anti-spam regulations.

• We do NOT share customer data, candidate data, interview results, or any organizational data with other job platforms, recruitment agencies, competitors, or any such third party for their independent use
• Data is used solely to provide the Service to the subscribing organization
• Our third-party service providers (categorized by function in our Privacy Policy) receive only the minimum data technically necessary to perform their specific function within the Service. These providers process data solely on our behalf and are contractually prohibited from using it for any other purpose.
• The Service provides employers with optional integration features (webhooks and Client API) that allow employers to transmit data to their own external systems. These integrations are configured and controlled entirely by the employer. We are not responsible for how the employer processes data received through these channels. You agree not to:

• Engage in fraudulent use, impersonation, or misrepresentation
• Use automated scraping, crawling, or data extraction on the Service
• Reverse engineer, decompile, or attempt to derive source code of the platform
• Use the Service to discriminate unlawfully on the basis of race, gender, religion, caste, disability, or any other protected characteristic
• Share account credentials or allow unauthorized access to your account
• Send interview invitations to individuals who have not consented or who are not genuine candidates
• Attempt to manipulate, circumvent, or game AI evaluation systems

• Platform IP (software, algorithms, designs, trademarks) belongs exclusively to Interview Express
• Customer retains full ownership of their data (job descriptions, candidate information, organizational data)
• We receive a limited, non-exclusive, revocable license to process customer data solely for the purpose of providing the Service
• AI-generated outputs (scores, analysis, reports) are licensed to the subscribing organization for their internal hiring purposes only

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

• No warranty of uninterrupted, error-free, timely, or secure service
• Total aggregate liability is capped at the amount paid by the organization in the 12 months preceding the claim
• Not liable for any indirect, incidental, special, consequential, or punitive damages
• Not liable for any hiring decisions made using AI-generated outputs
• Not liable for third-party service interruptions or outages (including but not limited to AI, speech processing, communication, and cloud infrastructure providers)
• Not liable for inaccuracies in AI-generated evaluations

You agree to indemnify and hold harmless Interview Express, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:

• Your use of the Service
• Your data and content uploaded to the platform
• Your hiring decisions
• Your violation of these Terms
• Your violation of any third-party rights
• Your failure to obtain proper candidate consent

All disputes arising out of or relating to these Terms or the Service shall be resolved exclusively via binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended).

• Arbitration seated in New Delhi, India (or the city of incorporation when established)
• Single arbitrator appointed by mutual agreement or by a competent court
• Proceedings conducted in English
• Each party bears its own arbitration costs; arbitrator fees shared equally
• Waiver: You waive the right to participate in class action, collective action, consolidated action, and representative proceedings
• Exception: Either party may seek injunctive relief in courts for IP infringement or data breach

Either party may terminate with 30 days’ written notice.

We may terminate immediately for: material breach, non-payment, fraudulent activity, violation of the Acceptable Use Policy, or repeated unsolicited invitations to non-consenting candidates.

Upon termination:

• Account access is revoked immediately
• Data is retained for 90 days after termination to allow retrieval, after which it is permanently deleted
• Credits are forfeited if terminated for cause by us
• Upon voluntary termination by you, unused credits are forfeited and non-refundable

Sections on Intellectual Property, Limitation of Liability, Indemnification, Arbitration, and Governing Law survive termination.

These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, the courts of New Delhi, India shall have exclusive jurisdiction over any disputes arising under these Terms.

We reserve the right to modify these Terms at any time. Changes will be reflected by updating the “Last Updated” date at the top of this page.

For material changes to these Terms (including changes to billing, liability, or data handling), we will notify registered users via email at least 15 days before the changes take effect. We encourage you to review this page periodically to stay informed of any updates.

Continued use of the Service after the effective date of updated Terms constitutes acceptance. If you do not agree with the revised Terms, you must stop using the Service.

If any provision of these Terms is held to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Interview Express regarding the use of the Service.
